General Terms and Conditions

  1. DEFINITIONS

    1. Foundation: Moksha Foundation is a non-profit organization based in Singapore, on the protection, conservation, and preservation of ancient archaeological sites in Nepal.

    2. Donation: any asset, including any monetary amount, gifted by a Donor to the Foundation.

    3. Donor: a natural or legal person who donates, has donated, or will donate a Donation to the Foundation.

    4. Program: The Foundation is committed to a number of causes that donors could specify, otherwise the Foundation will allocate the funds accordingly.

  2. APPLICABILITY

    1. These General Terms and Conditions apply to every Donation.

    2. By making a Donation, the Donor agrees with these General Terms and Conditions.

    3. The Foundation’s Donation Policy stipulates policies on disclosure, accountability, use of funds, and anti-money laundering and anti-terrorist funding.

  3. DONATIONS

    1. By making a Donation, a Donor agrees that the Foundation is entitled to use the Donation at their own discretion, within the scope of the Program.

    2. A Donation is irrevocable.

    3. Recurring donations can be canceled upon request by the Donor.

    4. The Foundation will provide any Donor with a donation certificate upon request by the Donor.

  4. FINAL PROVISIONS

    1. This General Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore.

    2. Any dispute arising out of or in connection with this General Terms and Conditions, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one arbitrators. The language of the arbitration shall be English.

    3. The Donor agree to waive any right to a jury trial or to participate in a class action.
